Depends on the specific avvy. I would suggest that you contact Mal privately, send the avvy to him, and ask him whether he would take administrative or legal action against you if you used it.
 
Because Mal is both Attorney General and an Administrator, as such he is perfectly placed to give you both the answer from a ToS point of view and from a Europeian prosecutorial point of view.

I feel it is simpler to just tell me the answer, I shouldn't have to ask in multiple places via different forms of communication simply to get a simple answer to a simple question. This isn't exactly rocket science.
 
Idk, I could ask if it would be cool to have a Ron Jeremy avatar, but it would definitely depen on the specific picture.
 
As Attorney General, I would say it is highly unlikely to be an issue under Europeian law. The only legal standard that I can see potentially being relevant is:

(19) Anyone who posts, sends, or uses pictures or text descriptions containing:

(i) pornography, defined herein as material containing the explicit description or display of sexual organs or activity;

(ii) explicit and realistic portrayals of murder, sexual assault, or other patently offensive actions;

...

on the Europeian Forum ... is guilty of the offense of Obscenity.

I would not expect a Yoko Littner avatar to meet that standard. However, as others have said, it depends on the specific picture.

The administrative standard in this area is likely higher. The relevant parts of the ToU are:

Prohibited Content ... includes:

Content that infringes upon any rights (including, but not limited to, copyrights and trademarks)
Abusive, threatening, defamatory, racist, or obscene Content
Viruses or any other harmful computer software
False information or libel
Spam, chain letters, or pyramid schemes
Gambling or Illicit drugs
Terrorism
Hacking or cheating for internet/online games
Warez, Roms, CD-Keys, Cracks, Passwords, or Serial Numbers
Pornography, nudity, or sexual material of any kind
Excessive profanity
Content that is invasive of privacy or impersonation of any person/entity
Hacking materials or information.

I can't speak for the admin team as a whole, particularly in the absence of a specific image to consider, but I would again doubt that a Yoko Littner avatar would be problematic.

I'm always happy to provide opinions on particular avatars to anyone who requests it. I would also note that both the admins and the Europeian legal system have a long-standing policy of notifying members of minor infractions and giving them an opportunity to correct the behavior. Prosecution and administrative enforcement are typically reserved for serious violation or instances where the infringer refuses to alter his or her behavior. In short, a long as one uses common sense and use avatars in a good faith belief that they aren't violating, there shouldn't be a problem with either the admin team of the legal system.
